Draft document. Before publishing, fill in the details in square brackets and have a lawyer review it. This is an informational translation; the Polish version is binding.
§ 1. General
- These terms govern the use of the website [website address], booking visits at the Artberry studio, Academy enrolment, and buying and redeeming gift cards.
- The service provider is [full company name], [registered address], NIP [number], REGON [number], email [email], phone [phone] (the Studio).
- The Studio provides its services at [studio address], Warsaw.
- Prices on the website are gross prices in Polish złoty.
§ 2. Services provided electronically
- Through the website the Studio provides, free of charge: the booking form, the Academy application form, the gift card order form and the newsletter.
- Using the website requires a device with an up-to-date web browser and an email address.
- Sending unlawful content is prohibited, including photos you do not hold the rights to.
- You can stop using a form at any time by not completing it. You can unsubscribe from the newsletter by writing to [email] or using the link in any message.
§ 3. Booking visits
- Sending the booking form is a request, not a confirmed appointment. The Studio replies within one working day with a proposed time, an approximate price range and the next step.
- The appointment is reserved once a 100 zł deposit (zadatek) is paid. The deposit counts towards the price of the service.
- You can reschedule free of charge up to 48 hours before the visit; the deposit then moves to the new date.
- If you cancel or reschedule later than 48 hours before the visit, or do not attend, the Studio may keep the deposit under Article 394 of the Polish Civil Code.
- If the Studio cancels the visit, the deposit is refunded in full or, at your choice, moved to a new date. Article 394 of the Civil Code governs any further consequences.
- The final price depends on size, complexity and working time, and is agreed with you before the service starts.
- The Studio may decline a service in the case of health contraindications, being under the influence of alcohol or other substances, or a missing parental consent. If the refusal results from health contraindications you could not have known about, the deposit is refunded.
§ 4. Age of clients
- Tattoos and permanent makeup are for clients aged 18 and over, and from 16 with written consent of a parent or legal guardian.
- Children’s earlobe piercing is available from age 3, with a parent or legal guardian present.
- Piercing for other minors: [rules to be set].
- The Studio may ask for proof of age.
§ 5. Academy
- An application through the form is a request. The Studio contacts you about your level, dates and course terms.
- A place on the course is confirmed once a 100 zł deposit is paid; it counts towards the course price.
- The detailed programme, schedule and terms are set out in a separate agreement.
§ 6. Gift cards
- A gift card can be used to pay for the Studio’s services: tattoo, permanent makeup and piercing, including children’s piercing [scope to be confirmed: Academy courses].
- Cards are available at 200, 350, 550 or 900 zł, or any amount from 200 zł.
- You buy a card through the form on the website and pay online via [payment provider]. Once the payment is credited, the card is sent as a PDF with a unique code to the email you give — to you or, if you choose, to the recipient on the date you set.
- A card can be redeemed only once the payment has been credited. A confirmation of a sent transfer is not proof of payment.
- A card is valid for [12] months from the date of purchase [to be confirmed]. The expiry date is shown on the card.
- To redeem a card, book a visit and give the card code. The card is a bearer card — the Studio is not responsible for use of the code by anyone it was shared with.
- If the service costs less than the card’s value, [the remaining amount stays available until the card expires — to be confirmed]. If it costs more, you pay the difference at the Studio.
- A card cannot be exchanged for cash.
- We issue an invoice on request if you give invoice details when buying.
- If you are a consumer, you may withdraw from the card purchase without giving a reason within 14 days of purchase, provided the card has not been used. Send a statement to [email]. We refund the payment within 14 days using the same payment method.
§ 7. Payments
- You can pay the deposit by: [payment methods — to be filled in].
- The rest of the price is paid at the Studio: [cash, card, BLIK — to be confirmed].
- Gift cards are paid online via [payment provider].
§ 8. Complaints
- You can make a complaint about a service, a gift card or the website by email to [email] or in person at the Studio.
- Describe the problem and what you expect. We reply within 14 days of receiving the complaint.
- A permanent makeup correction after healing is part of the treatment plan and is charged per the price list; it is not a complaint.
§ 9. Out-of-court dispute resolution
If you are a consumer, you may use out-of-court dispute resolution, including help from a municipal or district consumer ombudsman (rzecznik konsumentów) or mediation by the Voivodeship Inspectorate of Trade Inspection. Information is available on the website of the Office of Competition and Consumer Protection (UOKiK).
§ 10. Personal data
Personal data processing is described in the Privacy policy.
§ 11. Final provisions
- Matters not covered here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. These terms do not limit consumer rights under the law.
- We will announce changes to these terms on the website at least 14 days before they take effect. Services ordered earlier remain under the previous version.
- These terms apply from [publication date].
